1. Acceptance of Terms

By accessing or using CryWhy, you agree to these Terms & Conditions. If you do not agree, do not use the service.

2. Eligibility and Account Responsibility

CryWhy is intended for use by adults, including parents and caregivers. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

If you use sign-in providers or app store subscriptions, you are also bound by the terms of those providers.

3. Not Medical Advice

CRYWHY IS A PARENTING UTILITY DESIGNED TO ASSIST IN RECOGNIZING COMMON INFANT VOCALIZATION PATTERNS. IT IS NOT A MEDICAL DEVICE, NOR IS IT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PEDIATRICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF A RESULT PROVIDED BY THIS APPLICATION.

4. Service Description and No Guarantee

CryWhy provides automated cry analysis based on machine learning models. Results are probabilistic, may be incomplete, and may be incorrect. We do not guarantee uninterrupted availability, error-free operation, or any specific performance level.

5. Subscriptions, Trials, and Billing

CryWhy offers premium subscriptions providing access to core translation features. Subscriptions are billed and managed exclusively through the respective app store (Google Play Store or Apple App Store).

Trials, renewals, cancellations, billing dates, price changes, and refunds are controlled by the relevant app store. Because transactions are processed by third parties, CryWhy cannot issue refunds directly unless explicitly required by law.

6. Fair Usage and Account Sharing

Your CryWhy account and subscription are strictly for personal, non-commercial use. Account sharing is strictly prohibited.

To protect the integrity of our AI infrastructure, we enforce a Fair Usage Policy. If our systems detect simultaneous logins from an unreasonable number of devices, mismatched geographic IP addresses, or excessively high translation volumes indicative of automation, account sharing, or commercial use, we reserve the right to rate-limit, temporarily suspend, or permanently terminate your account without prior notice and without refund.

7. Acceptable Use and Model Protection

You agree not to misuse our application or its underlying AI models. You explicitly agree not to:

• Reverse engineer, decompile, or attempt to extract the source code, AI inference models, model weights, or architectural information from the application.
• Attempt to distill, replicate, or reproduce the trained models or their decision-making processes through any means, including systematic querying.
• Use automated scripts, bots, or scrapers to interact with our APIs or submit audio.
• Submit audio that is unlawful, harassing, or violates the privacy of others.

8. Your Content and Feedback

You retain rights you may have in the audio or feedback you submit, but you grant CryWhy a worldwide, non-exclusive license to host, process, analyze, reproduce, and use that material as necessary to operate, secure, improve, and train the service, subject to the Privacy Policy.

9. Intellectual Property

CryWhy, including its software, models, branding, UI, and related materials, is owned by CryWhy or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership to you.

10. Suspension and Termination

We may suspend or terminate access if you violate these Terms, abuse the service, fail to pay required fees, create security risk, or use the service in a way that harms users or infrastructure.

11. Limitation of Liability

To the maximum extent permitted by law, CryWhy and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising from your use of or inability to use the application, or from any inaccuracies in the AI translations provided. The application is provided strictly "as is" without warranty of any kind. We do not warrant that the service will be error-free, uninterrupted, or achieve any particular level of accuracy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Amsterdam, the Netherlands.

13. Changes to Terms

We reserve the right to modify these terms at any time. Your continued use of the application following any changes indicates your acceptance of the new terms.
